4802 EAGLE ROCK BLVD., LOS ANGELES CA 90041

Making an insurance claim can be confusing, especially after a car accident in Eagle Rock, Los Angeles, Pasadena or Glendale. To make the process as smooth as possible, follow our list of dos and don’ts when filing an insurance claim.

What to Do When Making an Insurance Claim

  • Do: As soon as you get home from a car accident, call your insurance agent to report it.
  • Do: Read the “Coverage” and “Exclusion” sections of your insurance policy before you speak with your insurance provider. Make sure you understand everything.
  • Do: Take notes whenever you have a conversation with an insurance company representative. Get their names, job titles and phone numbers every time you speak with them. Take down the name of their supervisor as well.
  • Do: Some people have more than one policy that could cover a claim. If you’re enrolled in homeowner or “umbrella” policies, check to see if you’re also covered under those.
  • Do: If possible, take photographs of damage to your vehicle, your injuries and the scene of the accident.
  • Do: Be honest and candid with your insurance provider. Otherwise, you could invalidate your policy or be denied coverage.
  • Do: Make sure you know the difference between depreciated or actual cash value and replacement coverage. If you have replacement cost coverage, you might have to replace lost items before getting fully reimbursed.
  • Do: Hold onto receipts for lodging, meals and purchases connected to your claim until the case has been settled with your insurance company.

What Not to Do When Making an Insurance Claim

  • DON’T: Until you are sure you understand your coverage, refrain from giving your insurer a written or recorded statement. Keep in mind that you don’t have to consent to a recorded telephone conversation with your insurance company. Consult an attorney of you have any questions.
  • DON’T: Do not accept the insurer’s initial estimate or appraisal of your losses. It could be a bit low, and you want to leave room to negotiate.
  • DON’T: Until you’ve spoken with an attorney, do not sign a waiver or release until a settlement’s been reached.
  • DON’T: Until you are ready, don’t accept any checks that say “final payment” on them.
  • DON’T: Most policies require a signed proof of loss within a specified time frame, typically within one year. Unless your insurance company provides a written waiver, comply with this requirement to maintain your right to sue.
  • DON’T: Don’t forget that your insurance provider is legally obligated to provide the coverage they promised you. Insist that they enforce it.
